Update: 9/1/2019 Three Denver City Council members are in the early stages of crafting a bill to ban plastic bags for customers of grocery stores and other retailers. It won’t be introduced for months, said Councilwoman Kendra Black. Council members also will have to navigate a 1993 law that may restrict local governments from regulating plastics. It has been the subject of some debate, but Telluride has nevertheless had a bag ban since 2011. Other Colorado cities, including Boulder, charge a fee for bags. “There’s some legal gray area,” Black said. But, she added: “I’ve been assured by some state legislators that they are going to repeal (the 1993 law). So I think the timing might just line up perfectly.” It reads: “No unit of local government shall require or prohibit the use or sale of specific types of plastic materials or products or restrict or mandate containers, packaging, or labeling for any consumer products.” While the legislation falls under the purview of the Colorado Department of Public Health and Environment, no means of enforcement has been established in the decades since its passage, Meghan Hughes, a spokesman for the department’s hazardous materials and waste management division, said. “If asked, we’d likely advise any jurisdiction looking to consider banning a plastic such as straws, plastic bags, etc., to consult with their attorney on the potential implications.” Chapman said the law did not come up during a recent lawsuit over the bag fee, indicating to her it will not be a factor for cities enacting bans. 12/2018 Recently had discussions at a council meeting about banning plastic bags.
